Terms of sale

1. Preamble

These terms of sale govern the sale of Fine Art prints, books and postcards concluded on the crackoi.com website between Éric Lamblin (Crackoï), photographer, and any adult natural person or legal entity (the "Customer").

Any order implies full and complete acceptance of these terms of sale.

2. Products

Crackoï offers for sale: Fine Art photographic prints produced on demand on Hahnemühle, Epson or Ilford baryta paper (310 gsm); the book "In the Intimacy of Whales"; postcards (15 × 21 cm, 275 gsm, gloss-laminated four-colour printing).

The essential characteristics of each product are described on its product page. Photographs are provided for illustrative purposes and may show slight differences in colour rendering depending on screens.

3. Prices

Prices are shown in euros (€), all taxes included (incl. VAT), excluding shipping costs. Shipping costs are calculated at checkout based on the delivery address and basket contents.

Crackoï reserves the right to modify prices at any time. Products are invoiced on the basis of the rate in force at the time the order is placed.

4. Order

The Customer places an order via the online basket. The order becomes firm and definitive once payment is confirmed. A summary email is sent to the address provided.

5. Payment

Payment is made exclusively online, by credit/debit card, via the secure Stripe platform. Crackoï never has access to the Customer's banking details. No order is prepared before effective receipt of payment.

6. Delivery

Products are shipped from Réunion Island worldwide. Indicative timelines are:

• Fine Art print: 2 to 3 weeks (including on-demand production)
• Book or postcards: 1 to 2 weeks

These times are indicative and Crackoï's liability cannot be engaged in case of delay attributable to the carrier. A tracking number is provided upon shipment.

7. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise the right of withdrawal, without having to justify any reason. The product must be returned in its original condition, unopened for books whose protective sleeve is intact.

Return shipping costs remain at the Customer's expense. The refund is issued within 14 days following receipt of the returned product.

Exception: in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised (prints dedicated at the customer's specific request).

8. Warranty and conformity

Products benefit from the legal warranty of conformity and the warranty against hidden defects under French law. In case of a non-compliant product, the Customer is invited to contact Crackoï via the Contact page.

9. Customer service

For any question, write via the Contact page. Reply within 48 working hours.

11. Applicable law and disputes

These terms are governed by French law. In case of dispute, an amicable solution will be sought before any legal action. Failing this, the French courts shall have exclusive jurisdiction.

In accordance with Article L612-1 of the French Consumer Code, the Customer may use the European online dispute resolution platform free of charge: ec.europa.eu/consumers/odr.
